A working page, open for review
This page is published while it is still being checked, so that people who know this law, and people it affects, can correct it. It explains the law in plain language, and it does not give legal advice or speak for the Forum, the municipality, or any other body. The official text, linked under At a glance, is what counts. Before you act on anything here, read the official text or ask the body named under Who to ask. To correct or add to this page, see How to Submit.
Questions for reviewers:
- For the Greater Overberg Fire Protection Association: does its membership cover land in Ward 2, and which Fire Management Unit do Greyton, Genadendal, and the surrounding farms fall in? Are Theewaterskloof Municipality and the national department, as owners of the commonage and of Farm 39, members?
- For the Overberg District Fire Services: is the description of the service’s role in Ward 2 correct?
- For Greyton Volunteer Firefighters: how does GVF work with the district fire services and the FPA on a call?
- Who answers for firebreaks on Farm 39 land and on the commonage around Greyton?
The National Veld and Forest Fire Act sets out how veldfires are to be prevented and fought, and who is responsible [IC]. It puts duties on every owner of land where a veldfire may start or spread, and it encourages landowners to form fire protection associations, which bring neighbours together to plan for fire [IC]. The valley sits between the Riviersonderend mountains and farmland, in fynbos that burns, so the Act applies across most of it.
What the letters in square brackets mean
Facts on this page are followed by a tag that shows where they come from.
- [IC] Independently Corroborated. Confirmed by the official text of the law, or by at least two sources that do not depend on each other.
- [MS] Mission-Sourced. Comes from one party’s own documents or statements. It has not been checked against other sources.
- [TBV] To Be Verified. Seems likely, but nobody has confirmed it yet.
Sentences without a tag under What it means in the valley are the Forum’s reading of how the rule could apply here. They are not legal advice.

What it does
- Fire protection associations. Owners may form a fire protection association (FPA) for an area, to predict, prevent, manage, and put out veldfires [IC]. An FPA registers with the national Department [IC].
- Firebreaks. “Every owner on whose land a veldfire may start or burn or from whose land it may spread must prepare and maintain a firebreak on his or her side of the boundary between his or her land and any adjoining land” (section 12(1)) [IC].
- Being ready. Owners must have the equipment, protective clothing, and trained people to fight fires, or make sure that someone responsible is present when they are away (section 17) [IC].
- The presumption of negligence. If someone suffers loss from a veldfire that started on or spread from another person’s land, that landowner is presumed to have been negligent until they prove otherwise, unless they are a member of a fire protection association in the area (section 34) [IC]. The person claiming must still prove that the landowner’s act or omission was wrongful [IC].
- Fire danger warnings. The Department publishes a fire danger rating, and lighting fires in the open is restricted when the danger is high [IC].
What it means in the valley
Who does what. Three bodies deal with veldfire in and around the valley:
| Body | What it does |
|---|---|
| Overberg District Fire Services | The fire brigade of the Overberg District Municipality. Its control room takes fire emergency calls for the district [IC], and it opened a fire station in Caledon to serve Theewaterskloof and the wider Overberg [IC]. |
| Greater Overberg Fire Protection Association (goFPA) | The umbrella fire protection association for the Overberg, registered under this Act as FPA 2013/02 [MS]. It handles administration, training, and planning for its members, who are grouped into Fire Management Units, and it says plainly that it does not provide a firefighting service [MS]. Its members’ land covers about 660,000 hectares, about 60% of the Overberg [MS]. |
| Greyton Volunteer Firefighters | Greyton Volunteer Firefighters NPC, a registered non-profit company and public benefit organisation, with two fire trucks of its own [MS]. The fire emergency number on its website is the district control room’s number [IC]. |
For landowners. Farms, smallholdings, and properties on the edge of Greyton and the mission settlements carry the firebreak and readiness duties. Joining an FPA removes the presumption of negligence, which matters for a landowner’s liability and often for insurance. The goFPA says any farm owner or landowner in the Overberg can join, for a joining fee and an annual fee, and that government departments, municipalities, and conservation authorities that own land in the Overberg must become members [MS]. Whether the land around Greyton and Genadendal falls within a goFPA Fire Management Unit today is not yet confirmed [TBV].
For volunteers. Greyton Volunteer Firefighters responded to about 50 wildfires across six villages in the Overberg in the months before February 2026 [IC]. The Act does not create volunteer teams, but the readiness it asks of landowners is part of what such teams supply.
For clearing and restoration. Invasive pines and wattles carry more fuel than fynbos [TBV]. Clearing work by Wild Restoration and the Zonderend Water Users Association also lowers fire risk, and planned burns in the nature reserve are a tool the Act and the FPA system allow for [TBV].
On Farm 39 and the commonage. On land held in trust by the Minister, or owned by the municipality, the duties of the “owner” fall on bodies that are not on site every day. Who answers for firebreaks on Farm 39 land and the Greyton commonage is an open question this site would like answered.
Municipal rules too. Theewaterskloof Municipality’s Community Fire Safety By-law, published in the Provincial Gazette (PG 7488) on 11 September 2015, adds local rules, for example on burning and fire hazards on properties [TBV].
