The Genadendal Transformasie Komitee is the committee elected by residents of Farm 39 to take part in the transfer of their land under the Transformation of Certain Rural Areas Act of 1998 (TRANCRAA) [IC]. Farm 39 is the land on which Genadendal, Bereaville, Voorstekraal, and Boschmanskloof stand [IC]. The Komitee was elected on 9 November 2004 [IC]. Court papers call it the Genadendal Transformation Committee [IC]. It takes part in the Ward 2 Development Forum (W2DF) as a stakeholder, and has an eight-sector plan for the valley [MS].
What the letters in square brackets mean
Facts on this page are followed by a tag that shows where they come from.
- [IC] Independently Corroborated. Confirmed by at least two sources that do not depend on each other, or by an official record such as a court order, a law, or a government report.
- [MS] Mission-Sourced. Comes from one party’s own documents or statements, or from the Forum’s research notes. It has not been checked against other sources.
- [TBV] To Be Verified. Seems likely, but nobody has confirmed it yet.
This page describes the Komitee’s positions only as its own documents and court papers state them. The Komitee has not yet reviewed this page.
The eight-sector plan
The Komitee has organised its plan for the valley in eight sectors [MS]:
- Farmers Union
- Inwonersvereniging (Residents Association)
- Social Welfare
- Education
- Business
- Sport, Arts and Culture
- Faith-based
- Youth
At its first meeting on 16 September 2026, the Forum agreed that the Komitee’s plan will be brought to the Forum and considered alongside the Forum’s five priorities [MS]. What each sector covers, and who leads it, will be added here once the Komitee has shared the plan.
Where the sectors meet this wiki
The table shows where entries related to each sector are filed on this site. It is a guide to finding them, prepared by the Forum. It does not describe the content of the Komitee’s plan.
| Komitee sector | Where related entries sit on this wiki |
|---|---|
| Farmers Union | Farmers, Land & Water |
| Inwonersvereniging | Residents Association |
| Social Welfare | Community Care |
| Education | Education |
| Business | Business |
| Sport, Arts and Culture | Sport, Heritage, Arts & Culture |
| Faith-based | Faith Communities |
| Youth | No single category. Youth initiatives are filed by subject and tagged youth. |
Seven of the eight sectors match one of the Forum’s categories. Two of the Forum’s nine categories have no matching sector: Tourism, and Governance, which holds this page.
How the Forum’s Categories Compare sets these sectors beside the Forum’s categories and the portfolios of a typical residents’ association.
How the Komitee was formed
- The municipality’s consultants held information meetings in each settlement in April and in August to September 2004 [IC]. At the smaller settlements, residents raised the concern that Genadendal would dominate decisions, and asked for their own representatives [IC].
- A community meeting on 26 October 2004 named the organisations to be represented [MS]. The Komitee was elected on 9 November 2004, and its constitution was adopted on 16 November 2004 [IC].
- TRANCRAA defines an “elected committee” as one elected by residents aged 18 or older, “which has satisfied the Minister that it represents the majority of such residents” [IC].
Who was represented in 2005
The April 2005 constitution lists 27 representatives from these bodies, plus three more chosen by the community [MS]:
- Theewaterskloof Municipality
- SWEDATRA Vrouegroep (women’s group)
- Genadendal Ontwikkelingstrust (GENOT)
- Genadendal Boerevereniging (farmers)
- Beskermingsdienste (protection services)
- Genadendal Gesondheid- en Welsynkomitee (health and welfare)
- Genadendal Jeugforum (youth)
- Schools
- Churches (two representatives)
- Belastingbetalersvereniging (ratepayers)
- Tourism
- Sport, and Genadendal Sport (GESOT)
- Bereaville, Voorstekraal, and Boschmanskloof (three representatives each)
- Additional members, including the environmental forum
Government departments that serve Genadendal could sit on the Komitee in an ex officio role [MS].
What its constitution says
The April 2005 constitution, written in Afrikaans, sets out these points [MS]:
- Purpose. To help the municipality finalise the implementation plan under section 3(4)(a) of the Act, to lead community decisions on how the land will be held and managed, to consult the community throughout, and to report the community’s recommendation on the receiving entity to the Minister.
- Duties. To give all residents a fair chance to take part in decisions about the transfer and administration of the land, to discriminate against no resident, and to make minutes and documents available to the municipality.
- Office-bearers. A chairperson, deputy chairperson, and secretary, elected at the first meeting.
- Quorum. Half of the member organisations plus one.
- Term. The 18-month transitional period, or an extension of six months if the Minister decides.
- Start and end. The constitution takes effect when the Minister publishes the section 3(4)(a) notice, and the Komitee dissolves once the land has been transferred to the chosen entity.
- Changes. The constitution can be amended by a majority of members, as long as the change does not conflict with the Act.
A code of conduct received by the municipality on 15 March 2005 requires members to act in good faith, attend meetings, and report back to the bodies they represent at least every quarter [MS].
Its record in the TRANCRAA process
The full history of the process is on TRANCRAA and Farm 39: The Land Transfer Process. The Komitee’s part in it:
| Date | What happened |
|---|---|
| 9 Nov 2004 | Komitee elected [IC] |
| Dec 2005 | Through its attorneys, asks for land sales to stop and for the consultants’ work to pause [IC] |
| 6 Jun 2006 | Declares a formal dispute, mainly over how the municipality appointed its consultants [IC] |
| 31 Jan 2007 | Applies to the High Court (case 926/07) to review the municipality’s actions, including “sale and transfer of trust immovable property” to outsiders [IC] |
| 27 to 28 Sep 2007 | Takes part in mediation at Houw Hoek with the Minister and the municipality [IC] |
| 17 Oct 2008 | Signs the settlement; the High Court makes it an order on 22 October 2008 [IC] |
| 17 Jun 2010 | Its attorneys write that the municipality is disregarding the court order [IC] |
| 5 Aug 2010 | Its attorneys write that the land “falls squarely within the area of Farm 39, which is held in trust for the community of Genadendal; and the whole of such land is subject to the provisions” of TRANCRAA [MS] |
| 2010 | Applies for an interdict, which did not stop the consultants’ report reaching the Minister [MS] |
| 10 Oct 2014 | Asks the Land Claims Court to stop the municipality and the province “alienating, encumbering or diminishing any portion” of Genadendal; the court strikes the matter from the roll for lack of jurisdiction [IC] |
| 2025 | Aligns with AfriForum and the Kaapse Forum; a Communal Property Association is being set up to receive the land [MS] |
| 16 Sep 2026 | Takes part in the Forum’s first meeting as a stakeholder [MS] |
The 2008 settlement gave the Komitee two seats on a new Steering Committee to oversee the process, alongside one seat each for the Department and the municipality [IC].
How others have described its role
These are the views of other parties, in their own words:
- The provincial Department of Local Government and Housing advised that the Komitee has “an advisory status” and no decision-making powers in municipal affairs [MS].
- The municipality’s consultants reported in 2010 that the Komitee’s majority did not accept the legal distinction between township land and the rest of Farm 39, and recommended that the land go to the municipality [MS].
- The Ward 2 Forum (2017), citing the consultants’ own entity report, wrote that the Komitee “did in fact manage, through an extended period of time, to properly and materially represent the interests of the community, and retain their support” [MS]. It added that later accusations questioning the Komitee’s legitimacy “have never been substantiated” [MS].
- The municipality wrote in 2016 that “a hostile environment has over the years developed between the TWK and the Transformation Committee”, and that it considered itself in dispute with the Minister, not with the Komitee [MS].
How this wiki works with the Komitee
- Every page on this site that deals with Farm 39 land, TRANCRAA, land tenure, or Madiba Park is sent to the Komitee for review, and carries a review flag until then.
- The site describes the Komitee’s positions only as its own materials state them.
- The Forum has agreed not to duplicate bodies already dealing with the TRANCRAA process [MS].
